Judge postpones an action for amparo against Fernandez

Viewed 15 times.The jueza-presidenta of the first room of Superior Administrative Tribunal, Judith Contreras Esmurdoc, reenvió yesterday for day 1 March the knowledge of an amparo action brought by several citizens and entities against the President of the Republic, Leonel Fernández, aimed at the removal of the director of the Department of prevention of the corruption administrative (DPCA), Otoniel Bonilla.
The instance promoted by entities Toy Jarto and Dominican Alliance against corruption (Adocco) and the citizens Remberto Pichardo Juan, Álvaro José Caamaño and others, was postponed at the request of the lawyers of President Fernandez, Tony Delgado and Flavio Darío Espinal, and Administrative Assistant Attorney General David Betances, who applied for a period of time to prepare his "means of defence".
At the end of the hearing, lawyers for the Chief of State described as "legally unfounded from every point of view", the u000aaction of amparo submitted, under the Director of the Department of prevention of the corruption administrative (CAPD) is an officer of free appointment and that this is a faculty which can not interfere any other power of the State, for being "unique and exclusive", the President of the Republic, according to the Constitution emphasized Tony Delgado.
Also described as irrelevant, frustratoria and unnecessary claim to bringing former judges of the Supreme Court of Justice, Jorge Subero Isa and Eglis Esmurdoc be heard as witnesses. The Court of appeal reserved judgement on this last request.
