Judges of the CT test knowledge of resources

The judges of the Constitutional Tribunal (TC) will have to be put to the test its independence to fail remedies of unconstitutionality that previous Supreme Court of Justice (SCJ) did not, as at least five of the most important were submitted by parties and political leaders.

Actions on unconstitutionality against the organic law of the Constitutional Court that is limited to 75 years age to belong to that Court, against the organic law of the National Judiciary Council (CNM) and the formation of this body, as well as the general budget of the 2012 law, are among the most important resources that will need to know the CT.

Two separate appeals against these laws and decisions were submitted by the parties Revolucionario Dominicano (PRD), revolutionary Social Democratic (PRSD), Alliance country, democratic institutional and reformist leader Amable Aristy Castro.

The delay of the Supreme Court of u000aJustice, according to TC, in knowing these resources reduces the effects of a possible ruling favorable to the plaintiffs.

Today Thursday, the Constitutional Court held its second session, two days after the first the last Monday. still not reported the calendar to meet audience 120 remedies of unconstitutionality that they will fail. the PRD was the first political organization that attacked unconstitutionality of the organic law of the NJC, on the grounds that it was approved in an irregular. The PRD rose action last March. One month u000alater, the PRSD President Hatuey de Camps, underwent a similar appeal against the same law, questioning, same as the PRD, the approval by a simple majority in the Chamber of Deputies. Remedies against such legislation were presented by several entities and personalities independently. They attacked this law, by means of unconstitutionality, the Federation of parents of private schools, the Bar Association and lawyers Manuel Labourt, Viriato Coradín and Guillermo Antonio Rosario.

Amable Aristy Castro underwent an appeal before the Supreme Court against the election of Senator Felix Vasquez to occupy the second position of the u000aSenate to the NJC.
