Most Dominican Government institutions do not comply with Public Procurement Act

Viewed 88 times.Two studies conducted by Participación Ciudadana, (Citizen Participation (PC)) show that over 42 percent of public institutions in the Dominican Republic do not properly follow the guidelines for procurement and contracting in the public sector.

The study revealed that among the institutions that do not comply with law 340-06 are the ministries of Agriculture, Sports, Environment and External Relations.
Santiago Sosa, general coordinator of PC, further reported that offices which comply partially with the legislation are the Chamber of Deputies, the Attorney General's Office and the Ministry of Health. The Supreme Court and the Attorney General’s office were among the leaders in compliance.
The study was conducted by analysis of the Annual Procurement Plan, the Register of Suppliers, the Tender Committee, and the publication of procurement and contracting details by the various institutions.
During the evaluation Sosa found that almost all the institutions surveyed limit themselves to simply advertising invitations to tender for contracts and purchases.
But despite this, the General Coordinator of PC noted that "according to the results of this monitoring there is evidence that the Dominican State has improved its purchasing and procurement system, given that there are tools to ensure implementation of the system and to achieve the institutionalization and transparency in these processes and good management of public funds.”
The study on the Implementation of the General Law on Public Procurement and Contracting of the Dominican Republic reveals that of the 10 institutions selected only seven produced an Annual Procurement Plan, two stated that they did not and one failed to answer the question.
Eighteen Government bodies failed to respond or refused to respond to the study, these were:
1. Accounts Chamber of the Dominican Republic
2. Dominican Telecommunications Institute (Indotel)
3. Junta Central Electoral
4. Ministry of Economy, Planning and Development
5. Ministry of Education
6. Ministry of Higher Education, Science and Technology
7. Secretary of State for Armed Forces
8. Ministry of Finance
9. Ministry of Industry and Trade
10. Secretary of State for Interior and Police
11. Secretary of State for Youth
12. Secretary of State for Women
13. Secretary of State for Culture
14. State Department of Public Works and Communications
15. Secretary of State for Labor
16. Secretary of State for Tourism
17. Secretary of State for Public Service
18. The Senate
