SCJ confirms ruling on foreign born
posted on: Dec 1 2011 8:23 by RDugey. Viewed 28 times.The Supreme Court of Justice ratified by judgment, that the children of foreigners in transit born within the national territory not acquire Dominican nationality, as provided for in the Constitution in paragraph 1 of article 11.
In the ruling No.460 the highest Judicial Tribunal expressed that paragraph 1 of article 11 of the Constitution excludes legitimate children of foreigners resident in the country in diplomatic representation or those who are transit therein to acquire Dominican nationality by Jus Solis, that these people have been authorized to stay for a certain time in the country.
"If in this circumstance, obviously legitimate, a foreign shine in the national territory, his son (a), as mandated by the Constitution itself, not born Dominican;" which, a fortiori cannot be what the son (a) of the foreign mother who at the time of giving birth is in a situation u000a"irregular and therefore cannot justify its entry and permanence in the Dominican Republic", said the Court in its judgment.
