Erickson Dimas Martinez was sentenced to capital punishment in 2010 for the murder of Derrick Jefferson, 17 years old, and to life imprisonment by the Commission of a robbery.
His lawyers appealed the ruling alleging that a member of the jury was on Twitter during the trial, despite specific orders from the judge not to conduct any kind of communication about the case.
Another Member of the jury, according to the defence, had been asleep.
The Supreme Court of the State of Arkansas ruled that due to the nature of Twitter as a social network, the trills of the jury, identified as Randy Franco, constitute public discussion.
The judge Donald Corbinexpressed concern that, with the phones of high u000atechnology, any member of a jury can access the Internet and, in addition to using social networks, can also download unduly information on cases before a trial.
Benton County authorities will have to set date for a new trial against Dimas Martínez.
